These Terms and Conditions govern:

Any legal relationship between the User and Pistacchiu regarding the purchase of artisanal food products.

By using this Site, you fully accept these Terms.

2. Key information

The Site is intended exclusively for Consumers.

The right of withdrawal applies only to European Union Consumers, with exceptions for perishable food products.

By purchasing from the Site, the User declares to be at least 18 years old and has the legal capacity to conclude contracts.

3. Conditions of use of the Site

3.1 User Requirements

By browsing or purchasing, the User declares to:

Act as a Consumer;

Use the Site in compliance with the law.

3.2 Account registration

The User can create an account by providing truthful and complete data.

He is responsible for the confidentiality of his credentials.

Any use made through the account is attributed to the User.

The User must immediately report any unauthorized access.

3.3 Account closure and suspension

The User can request the closure of the account at any time.

Pistachiu may suspend or cancel an account, without notice, in the event of violations of the Terms or inappropriate behavior.

There are no refunds in case of suspension due to violations by the User.

4. Site Contents

All contents (texts, photos, graphics, descriptions, recipes, packaging, digital materials) are the property of Pistacchiu or their respective licensors.

The User cannot:

Copy, modify, distribute, sell or create derivative works;

Use the content for commercial purposes;

Share copyright-infringing materials.

Where expressly indicated, the User can download content for personal and non-commercial use.

5. Access to external resources

The Site may contain links to third-party content or services. Pistachio:

Has no control over the external content

Is not responsible for the availability, correctness or security of the linked sites.

6. Allowed use

The User cannot use the Site to:

Illegal activities;

Violate the rights of third parties;

Attempt unauthorized access;

Transmit offensive or harmful content;

Cause damage to the Holder.

Pistachiu may take measures to protect its interests, including:

Block access to the Site

Report activity to the authorities

Suspend or close account

7. Terms and Conditions of Sale

7.1 Artisanalist food products

The products offered (creams, pests, sweets, condiments and pistachio derivatives) are artisanal.

Colors, texture and shape may vary from the images.

7.2 Prices

The prices indicated on the Site:

Are expressed in EUR;

They can change without notice

Price of the product will always be indicated as price = (variable price).

DUTIES

For all direct shipments to countries not belonging to the European Union (or to territories subject to a special customs regime), the prices of the products displayed on the Site and the shipping costs calculated at checkout do not include any customs duties, import taxes, local VAT, customs clearance duties or administrative fees applied by the authorities of the destination country.

These ancillary charges and customs fees are the exclusive and complete responsibility of the recipient and will be requested directly by the courier in charge or by the local customs authorities at the time of delivery of the goods or before customs clearance of the same.

Non-Delivery and Refusal of Goods: The User/Buyer is required to inquire about the customs regulations and import costs in force in their country before placing an order. If the recipient refuses to deliver the package or refuses to pay the duties and taxes due:

Any storage costs, costs of returning the package to our headquarters or penalties applied by the customs authorities will be fully retained or charged to the Buyer.

7.3 Purchase procedure

The procedure includes:

Product choice and addition to cart

Entering personal data and address

Choice of payment and shipping method

Order review

Confirmation and payment

Confirmation email receipt

The User is responsible for the correctness of the data entered.

7.4 Sending the order

Sending the order generates:

A binding contract between User and Pistachiu;

The obligation to pay the total indicated.

The User will receive emails from:

Order confirmation

Shipping confirmation with tracking

8. Payments

Accepted methods:

Cards (credit, debit, prepaid)

PayPal

Digital wallets (Apple Pay, Google Pay)

Bank transfer

Cash on delivery (cost: price = (variable price))

Payment data is never saved on Pistacchiu’s servers.

9. Retention of title

The products remain the property of Pistachiu until full payment.

10. Delivery

The delivery takes place at the address indicated by the User.

The User must check the package on delivery and report anomalies.

The times indicated are estimates and may vary.

Non-delivery

In case of non-collection, the package is returned to the sender. A new delivery attempt may be scheduled, with any costs borne by the User.

11. Right of withdrawal

IMPORTANT FOR FOOD PRODUCTS

It is not possible to exercise the right of withdrawal for:

Perishable products

Sealed products opened after delivery

Personalized products (e.g. gift boxes)

For other products, the EU Consumer can withdraw within 14 days.

11.1 How to exercise the withdrawal

11.2 Refund

The refund:

Includes the payments made

It is made within 14 days of notification of withdrawal

Use the same payment method as the order

Provided that the packages are sealed and intact

12. Legal guarantees

The products are covered by a legal guarantee of conformity according to EU legislation.

13. Limitations of liability

Pistacchiu is not responsible for:

Courier delays

Improper use of the product

Damages resulting from errors attributable to the User

Third-party malfunctions (hosting, couriers, payment gateways)

Pistachiu guarantees however:

Good faith

Product quality

Production processes in accordance with food regulations

14. Anleva

The User undertakes to indemnify Pistacchiu for damages caused by:

Incorrect use of the Site

Violation of the Terms

Dissemination of illegal or unauthorized content

15. Privacy

The processing of personal data is regulated in the Privacy Policy available on the Site.

16. Intellectual property

All brands, logos, texts, photographs, graphics and content are the exclusive property of Pistacchiu.

17. Changes to the Terms

Pistacchiu may modify these Terms at any time.

The continued use of the Site constitutes acceptance of the new conditions.

18. Assignment of the contract

Pistacchiu may assign or transfer its rights and obligations to third parties.

The User cannot do so without the written consent of the Owner.

19. Applicable law and jurisdiction

The Terms are governed by Italian law.

For any dispute, the Court of the place where the Data Controller is established is competent, unless otherwise provided for EU Consumers.
